H.R.1’s rules on Prohibited Foreign Entities (“PFE”) could be challenging to comply with, given their complications, often leading to misunderstandings. L4GG will provide a series of webinars to help Elective Pay entities navigate through these challenges.

This webinar series will provide attorneys with a detailed examination of the material assistance rules related to Prohibited Foreign Entities (PFEs) under H.R.1, focusing on the practical and legal compliance issues that Elective Pay entities are likely to encounter. Participants will gain a clear understanding of the key components of the PFE material assistance provisions, including statutory definitions, compliance triggers, and common areas of misinterpretation that can lead to enforcement risk.

The session will also include a comparative analysis between the new PFE material assistance rules and the existing Domestic Content and Build America Buy America (“BABA”) compliance frameworks, highlighting similarities, differences, and implications for legal counsel. Through this substantive overview, attendees will enhance their professional competence in advising clients on federal compliance strategies and risk mitigation on clean energy projects subject to multiple sets of requirements.

Edward Yim, Director of Clean Energy: Climate Change & Environmental Justice

Edward has served in all levels of government as policy expert, thought leader, and legal counsel on clean energy and resilient infrastructure, and he has worked in the nonprofit and private sectors with energy companies and public utilities. As an energy policy advisor for the District of Columbia government, Edward led the development of its innovative climate action & energy plan, the citywide electrification roadmap, the first Solar for All program, and grid modernization strategies including non-wires and non-pipe alternatives. Recently, he helped implement the IRA Home Energy Rebates at the US Department of Energy, after serving as Director of State and Utility Policy at the American Council for an Energy Efficient Economy. At L4GG, he helps communities access IRA funding and navigate legal complexities of decarbonization planning. 

He previously served in regulatory and governance roles across environmental nonprofits and state energy offices. 

Camille Edwards-Bennehoff, Senior Staff Attorney: Clean Energy & Tax

Camille brings her passion for serving the public and wealth of experience as a tax attorney and tax preparer to Lawyers for Good Government (L4GG), where she advises on tax law matters. Before joining L4GG, Camille spent seven years working in the National Office of the Internal Revenue Service Office on Chief Counsel (IRS) where she worked on a variety of tax law guidance and litigation matters, including drafting guidance and providing advice for implementation of fuel tax credits under the Inflation Reduction Act of 2022 (IRA) and the Superfund excise taxes. Camille’s work on IRA matters included drafting notices for the section 40B (sustainable aviation fuel) and section 45Z (clean fuel production) credits. Before working for the IRS, Camille clerked for over two years for Special Trial Judge Peter Panuthos at the United States Tax Court where she wrote opinions and orders on a variety of tax cases including individual income taxes, tax penalty, and collection due process matters, and supervised a legal intern for the judicial chambers. She also worked on state and local tax matters and tax returns for PwC in San Diego and for a small tax law firm in San Diego. 

Jillian Blanchard, Vice President, Climate Change & Environmental Justice, Lawyers for Good Government 

Jillian Blanchard is the Vice President of Lawyers For Good Government’s Climate Change and Environmental Justice Program and a nationally recognized attorney in energy and natural resources law. Ms. Blanchard has worked in all levels of government, nonprofit, and the private sector on environmental, infrastructure, and climate change issues for over 25 years. In 2018, she helped craft Governor Gavin Newsom’s climate change platform as part of his reelection campaign and regularly advises cities and public agencies on infrastructure, environmental, and energy issues. As vice president of the Climate Change and Environmental Justice Program at L4GG, she has managed over 600 lawyers to help provide critical guidance to cities, states, and nonprofit partners to help expedite the country’s shift to a clean and equitable green economy and to address environmental justice. For the past year, she has helped L4GG’s Climate Change & Environmental Justice Program become a national leader in advising on the implementation of the Bipartisan Infrastructure Law and the Inflation Reduction Act. 

Amy Lamson, Policy & Compliance Advisor, Clean Energy & Environmental Justice

Amy supports clean energy and infrastructure programs by providing technical assistance to help states and communities comply with domestic sourcing requirements. Prior to joining L4GG, Amy led the U.S. EPA’s implementation efforts on Build America Buy America and participated as a senior analyst on many air pollution regulations. Additionally, Amy previously served as an environmental protection specialist at the Federal Highway Administration. Amy has a Master of Science in Environmental Science degree and a Master of Public Affairs degree from Indiana University.

A.C. Meyer, Supervising Attorney, Clean Energy & Tax.

A.C. Meyer’s experience with the clean energy tax credits contained in the Inflation Reduction Act (“IRA”) began before the legislation’s passage as they kept clients up to date as congress revised the bill prior to its passage and subsequent enactment into law. In addition to providing information about the IRA credits to clean energy producers, A.C. has worked with clients to draft comments to Treasury regarding proposed Treasury regulations and has authored numerous informational and educational resources relating to clean energy tax credits.

Prior to joining Lawyers for Good Government, A.C. Meyer spent 4 years working in tax and policy at an Am Law 50 firm advising clients on clean energy tax credit requirements and assisting in the design of energy generation projects in order to maximize tax credit eligibility.
